Then why does torres look back at the ref before he passes. He's looking to see if he has gotten away with it.

Maybe he thought there was an offside call behind him? Maybe he thought the foul had been called further back despite no phase of play happening there?
Either way, it was a silly error and misjudgement on his behalf.
